These Terms & Service Policies ("Terms") govern all services, installations, repairs, diagnostics, and equipment sales provided by HelmTech Marine LLC ("HelmTech Marine," "we," "us," or "our") to the customer ("Customer," "Client," or "you"). By requesting an estimate, approving a quote, submitting a deposit, or authorizing HelmTech Marine to perform work on any vessel, you agree to be bound by these Terms.

1. Estimates & Scope of Work

  • Basis of Estimates: All written or verbal estimates are based on initial visual inspections and information available at the time of quoting. Estimates reflect anticipated labor, parts, materials, and travel costs.

  • Scope Changes: Any work requested outside the agreed written estimate, as well as unexpected complications or discovered conditions, will require customer authorization prior to execution. Additional labor, components, hardware, or mobile trip charges will apply.

  • Diagnostic Labor: Diagnostic and troubleshooting work is billed at HelmTech Marine’s standard hourly rate. Identifying an electrical or networking issue does not guarantee that repair labor or replacement hardware is included in the initial diagnostic fee.

2. Scheduling, Weather & Mobile Access

  • Service Availability: Mobile service appointments are subject to weather conditions, marine access, technician safety, and parts availability. HelmTech Marine reserves the sole right to delay or reschedule work when weather, sea state, extreme temperatures, or environmental conditions make mobile service unsafe or impractical.

  • Vessel Access: The Customer is solely responsible for ensuring HelmTech Marine technicians have safe, unhindered access to the vessel, keys, battery switches, lockboxes, and marina premises at the agreed-upon date and time.

  • Access Delays & Cancellations: Customers must provide at least 24 hours' notice for cancellations or rescheduling. If a technician arrives at the scheduled time and location but cannot access the vessel, keys, or marina, a standard mobile trip charge and minimum labor fee will apply.

3. Parts, Deposits & Special Orders

  • Deposit Requirements: Special-order equipment, custom dash panel fabrication, or large-scale hardware packages require deposit payment before parts are ordered or work is scheduled.

  • Restocking & Freight Fees: Special-order, non-stocked, or custom components are subject to supplier and manufacturer return policies. If a customer cancels an order or changes project scope after parts have been ordered, any applicable manufacturer restocking fees (typically 15%–25%) and non-refundable freight charges will be deducted from any deposit or billed directly to the Customer.

4. Pre-Existing Conditions & Unforeseen Issues

  • Latent Marine Deficiencies: Marine environments present hidden hazards, including corroded wiring, un-fused circuit branches, degraded insulation, moisture intrusion, and improper legacy modifications by past owners or technicians. HelmTech Marine is not responsible for repairing pre-existing electrical or mechanical defects unless explicitly contracted to do so in the written scope of work.

  • Discovered Complications: If legacy wiring spiderwebs, hidden moisture, structural obstructions, or incompatible networking are discovered during installation, HelmTech Marine will pause work and notify the Customer with a proposed path forward and updated cost estimate.

5. Customer-Supplied Equipment

  • Pre-Approval: HelmTech Marine may install customer-supplied equipment solely by prior written agreement, provided the hardware is complete, compatible, and in suitable working condition.

  • No Hardware Warranty: HelmTech Marine provides no warranty whatsoever on customer-supplied hardware, its internal functionality, software compatibility, or longevity.

  • Billable Removal & Diagnostics: If customer-supplied hardware proves defective, incompatible, or dead-on-arrival (DOA) during or after installation, all labor incurred by HelmTech Marine to install, test, troubleshoot, or remove the unit remains 100% billable.

6. One-Year Limited Workmanship Warranty

HelmTech Marine stands firmly behind its installation quality and technical execution.

  • Workmanship Coverage: Installation labor, terminal crimps, NMEA 2000 network drops, fusing, bus bar connections, and mechanical component mountings performed by HelmTech Marine are warranted against defects in workmanship for one (1) year from the date of service completion.

  • Remedy: If a failure occurs due to an installation error by HelmTech Marine within the warranty period, HelmTech Marine will inspect and correct the labor defect at no charge. For vessels located outside our standard mobile service radius, standard mobile travel fees may apply to warranty service calls.

  • Manufacturer Hardware Warranties: All physical equipment, chartplotters, radars, transducers, VHF radios, gauges, and accessories carry only the original manufacturer’s warranty (e.g., Garmin, Raymarine, Simrad, Actisense, Maretron). HelmTech Marine does not independently warrant manufactured hardware, but can assist customers in facilitating manufacturer warranty claims or RMAs upon request.

Warranty Exclusions & Limitations

The HelmTech Marine Workmanship Warranty is immediately voided under any of the following circumstances:

  1. Third-Party Tampering: Any modification, tapping, cutting, splicing, re-routing, or alteration of HelmTech Marine-installed wiring, NMEA 2000 backbones, panels, or protection devices by the Customer or another third party.

  2. Environmental & Water Damage: Damage resulting from bilge flooding, vessel submersion, direct water intrusion through pre-existing hull/window leaks, severe weather, lightning strikes, power surges from faulty shore power, or galvanic corrosion/electrolysis.

  3. Owner Neglect & Abuse: Battery voltage drops due to improper charging or maintenance, physical impact damage, overloading circuits beyond designated breaker/fuse ratings, or operating equipment outside manufacturer guidelines.

  4. Notice Required: The Customer must notify HelmTech Marine of any suspected installation defect within 14 days of discovery. Continued operation of malfunctioning electrical gear after a problem is detected voids warranty coverage for any resulting consequential damage.

7. Payment Terms

  • Due Date: Payment is due in full upon completion of the authorized work unless alternative written terms have been established on the approved quote or invoice.

  • Late Payments: Accounts past due by more than 15 calendar days will accrue a late charge of 1.5% per month (18% per annum) or the maximum legal rate allowed by law, whichever is lower.

  • Collection Expenses: In the event legal action or a collection agency is required to recover unpaid balances, the Customer agrees to pay all reasonable collection costs, court fees, and attorney fees incurred by HelmTech Marine LLC.

8. Limitation of Liability

  • Exercise of Care: HelmTech Marine LLC will exercise reasonable professional care while servicing your vessel in accordance with standard marine technical practices (e.g., ABYC guidelines where applicable).

  • Consequential Damages: To the maximum extent permitted by applicable law, HelmTech Marine LLC shall not be liable for any indirect, incidental, special, punitive, or consequential damages—including but not limited to loss of use, haul-out fees, slip fees, lost charter revenue, tournament entries, towing costs, or alternative transportation—arising out of or in connection with our services or installed equipment.

  • Maximum Liability: HelmTech Marine LLC’s total aggregate liability for any claim arising out of or related to services performed shall not exceed the total amount actually paid by the Customer to HelmTech Marine for the specific labor giving rise to the claim.

9. Customer Authorization & Acceptance

By approving a HelmTech Marine quote electronically (via Jobber or email), remitting a project deposit, or authorizing a technician to commence work on a vessel, you confirm that you are the legal owner of the vessel or an authorized representative of the owner, and you explicitly accept and agree to all terms, conditions, and warranty limitations set forth in these Terms & Service Policies.
